Privacy Policy
Effective date: September 13, 2026
NEGRO by Carldiny Calixte (“NEGRO”, “we”, “us”, or “our”) respects your privacy. This Privacy Policy explains what personal information we collect through shopnegro.com (the “Site”), how we use and share it, and the choices and rights you have, including the rights of California residents under the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, the “CCPA”) and the California Online Privacy Protection Act. This policy applies to information collected online through the Site and through our email and customer service communications.
1. Information we collect
Information you provide to us
- Identifiers and contact details: name, email address, phone number, billing and shipping address.
- Account information: username, password (stored in encrypted form), saved addresses, and preferences, if you create an account.
- Order and commercial information: products purchased or considered, order history, and payment confirmation. Payment card details are collected and processed directly by our payment providers; we do not store your full card number.
- Age verification: date of birth and, for tobacco products, identity verification data required by law to confirm that you are 21 or older.
- Communications: the content of messages you send us, reviews you submit, and your newsletter subscription.
Information collected automatically
When you visit the Site we and our service providers automatically collect internet and network activity information such as your IP address, approximate location derived from it, browser and device type, operating system, referring pages, the pages you view, the products you look at or add to your cart, and the dates and times of your visits. We collect this through cookies, pixels, and similar technologies described in section 4.
Information from other sources
We may receive information from our payment providers (for example, confirmation that a payment was authorized or flagged as potentially fraudulent), from shipping carriers (delivery status), and from social media platforms if you interact with our accounts there.
2. How we use your information
- To process and deliver your orders, send order confirmations and shipping updates, and handle returns and refunds.
- To create and manage your account and provide customer service.
- To verify your age and identity where the law requires it, in particular for tobacco products.
- To send you marketing emails about product launches, releases, and news, if you subscribed or made a purchase, with an easy way to unsubscribe in every message.
- To operate, secure, and improve the Site, understand how it is used, and remember your preferences and cart.
- To detect and prevent fraud, abuse, and security incidents.
- To comply with legal obligations, including tax, tobacco sales, and record-keeping requirements, and to enforce our Terms.
3. How we share information
We do not sell your personal information for money. We share it only as described here:
- Service providers that work on our behalf and are bound by contracts limiting their use of your data: payment processors, shipping carriers (such as UPS and USPS), age verification services, our web hosting and IT providers, email and newsletter services, and analytics providers.
- Advertising and analytics partners. If we use advertising cookies or pixels (for example, from Meta or Google) to measure campaigns or show you relevant ads, those partners may collect information about your activity on the Site. Under California law this can be considered “sharing” for cross-context behavioral advertising. You can opt out as explained in section 6.
- Legal and safety reasons: when required by law, regulation, subpoena, or court order, or to protect the rights, property, or safety of NEGRO, our customers, or others.
- Business transfers: if NEGRO is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this policy.
4. Cookies and tracking technologies
We use cookies and similar technologies for three purposes: essential cookies that make the Site and the shopping cart work, analytics cookies that help us understand how visitors use the Site, and, where enabled, advertising cookies that help us measure and personalize marketing. You can control cookies through your browser settings; blocking essential cookies may prevent you from placing an order. Our Site does not currently respond to “Do Not Track” browser signals, because there is no common standard for them. We do honor the Global Privacy Control (GPC) signal as a request to opt out of the sale or sharing of personal information, as required by California law.
5. How long we keep information
We keep personal information for as long as needed for the purposes described above: order and payment records for as long as required by tax, accounting, and tobacco sales laws (generally at least seven years), account information until you ask us to delete your account, and marketing data until you unsubscribe. We then delete or de-identify the information unless a longer retention period is required by law.
6. Your California privacy rights
To the extent the CCPA applies to NEGRO, California residents have the following rights regarding their personal information:
- Right to know what personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we shared it, and to receive a copy of it.
- Right to delete personal information we collected from you, subject to legal exceptions such as completing a transaction or complying with a legal obligation.
- Right to correct inaccurate personal information.
- Right to opt out of the sale or sharing of your personal information. We do not sell personal information. To opt out of sharing for advertising, email us or enable the Global Privacy Control signal in your browser.
- Right to limit the use of sensitive personal information. We use sensitive information (such as identity data for age verification and precise account credentials) only for the purposes permitted by law.
- Right to non-discrimination for exercising your rights. We will not deny you goods or services, charge different prices, or provide a different level of service because you exercised a privacy right.
To exercise these rights, email contact@shopnegro.com with the subject “Privacy request” or call +1 (661) 646-8822. We will need to verify your identity, usually by matching the information in your request with the information in our records, and we may ask for additional information to do so. You may designate an authorized agent to make a request on your behalf; we will ask for proof of that authorization. We will respond within 45 days, and we may extend that period once by another 45 days when reasonably necessary, in which case we will let you know.
In the past 12 months we have collected the categories of personal information listed in section 1, for the purposes listed in section 2, and disclosed them to the categories of recipients listed in section 3. We do not knowingly sell or share the personal information of consumers under 16 years of age.
“Shine the Light” requests
California Civil Code section 1798.83 permits California residents to request certain information about our disclosure of personal information to third parties for their own direct marketing purposes. We do not share personal information with third parties for their own direct marketing. To make a request, email contact@shopnegro.com.
7. Other U.S. states and international visitors
Residents of other states with privacy laws (such as Colorado, Connecticut, Virginia, and Texas) may have similar rights of access, correction, deletion, portability, and opt-out. You can exercise them through the same contact channels. The Site is operated from the United States and your information is processed and stored in the United States. If you visit from outside the U.S., you understand that your information will be transferred to and processed in the U.S., where privacy laws may differ from those of your country.
8. Marketing choices
You can unsubscribe from marketing emails at any time using the link in any message or by emailing us. We will still send transactional messages about your orders and account. If we offer text message marketing, we will only send messages with your consent, and you can reply STOP to opt out.
9. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption of data in transit (HTTPS), restricted access to our systems, and payment processing by PCI-compliant providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach affecting your unencrypted personal information, we will notify you as required by California Civil Code section 1798.82.
10. Children and minors
The Site is intended for adults. We do not knowingly collect personal information from children under 13, and we do not sell or share the personal information of anyone under 16. Tobacco products are sold only to customers 21 and older. If you believe a minor has provided us with personal information, contact us and we will delete it.
11. Third-party sites
The Site may link to third-party websites and social media platforms. Their privacy practices are governed by their own policies, which we encourage you to read.
12. Changes to this policy
We may update this Privacy Policy from time to time. We will post the revised version on this page with a new effective date and, for material changes, notify you by email or with a notice on the Site before the change takes effect.
