These Terms and Conditions (“Terms”) govern your access to and use of shopnegro.com (the “Site”) and any purchase you make through it. The Site is operated by NEGRO by Carldiny Calixte (“NEGRO”, “we”, “us”, or “our”), a business based in the State of California, United States. Please read these Terms carefully. By using the Site or placing an order you agree to be bound by them and by our Privacy Policy and Shipping & Returns policy, which are incorporated by reference.

1. Eligibility and age requirements

You must be at least 18 years old to use the Site and to place an order. Tobacco products, including cigars, are sold only to customers who are 21 years of age or older, as required by federal law and California law. By ordering a tobacco product you confirm that you are at least 21, that you are purchasing for your own use, and that the purchase and delivery of tobacco products are lawful at your delivery address. We verify age at checkout and at delivery, and we may cancel any order that fails verification. Tobacco products are shipped only to addresses where such shipments are permitted and require an adult signature on delivery.

2. Your account

An account is not required to order, but you may create one to track orders and save your details. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at contact@shopnegro.com if you suspect unauthorized use. You agree to provide accurate and current information.

3. Products, pricing, and availability

All prices are shown in U.S. dollars and exclude applicable sales tax, which is calculated at checkout based on the shipping address. We try to describe our products and display their colors accurately, but we do not guarantee that descriptions, photographs, or other content are error-free, and the appearance of products may vary on different screens. Product availability, prices, and promotions may change at any time without notice. Items marked “Coming Soon” are not available for purchase until released.

If a product is listed at an incorrect price or with incorrect information because of a typographical or system error, we reserve the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed and your payment method charged. If your payment has already been processed for a cancelled order, we will issue a full refund.

4. Orders and payment

Your order is an offer to buy. We confirm acceptance when we send the shipping confirmation. We may limit or cancel quantities per person, per household, or per order, and we may refuse any order at our discretion, including orders that appear to be placed by resellers. Accepted payment methods are shown at checkout and may include major credit and debit cards, Apple Pay, Google Pay, and PayPal. Payments are processed by third-party payment providers; we do not store your full card number on the Site. By submitting payment you represent that you are authorized to use the payment method provided.

5. Shipping, risk of loss, and returns

Shipping methods, delivery estimates, international shipping, and our return and refund terms are described in our Shipping & Returns policy. Title and risk of loss pass to you when we deliver the products to the carrier, except that we will help resolve any shipment that is lost or damaged in transit as described in that policy.

6. Promotions and gift cards

Promotional codes and offers are subject to the terms stated with the promotion, cannot be combined unless stated, have no cash value, and may be withdrawn at any time. Gift cards, if offered, are not redeemable for cash except where required by law.

7. Intellectual property

The NEGRO name, the NEGRO by Carldiny Calixte logo and emblem, and all content on the Site, including text, photographs, product designs, graphics, and the look and feel of the Site, are owned by or licensed to NEGRO and are protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission, other than viewing it for your personal, non-commercial use.

8. Reviews and user content

If you submit a review, comment, photo, or other content, you grant NEGRO a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and display that content in connection with the Site and our marketing. You represent that your content is truthful, that you own it or have the right to share it, and that it does not infringe the rights of others. We may remove any content at our discretion. Reviews must reflect your genuine experience with the product.

9. Prohibited uses

You agree not to use the Site for any unlawful purpose, to purchase products for unlawful resale, to interfere with the security or operation of the Site, to scrape or copy its content by automated means, to submit false information or fraudulent orders, or to attempt to gain unauthorized access to any account, system, or data.

10. Third-party links and services

The Site may contain links to third-party websites and uses third-party services such as payment processors and shipping carriers. We are not responsible for the content, policies, or practices of third parties. Your use of their services is governed by their own terms.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except for any warranties that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted or error-free. Fragrance and grooming products should be used as directed; discontinue use if irritation occurs. Nothing on the Site is medical advice.

12. Limitation of liability

To the fullest extent permitted by law, NEGRO and its owner, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Site or any product purchased through it. Our total liability for any claim relating to the Site or an order will not exceed the amount you paid for the product that gave rise to the claim. Some jurisdictions, including California in certain circumstances, do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless NEGRO from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

14. Governing law and disputes

These Terms and any dispute arising out of or relating to them, the Site, or any order are governed by the laws of the State of California and applicable federal law, without regard to conflict of law principles. If you have a concern, please contact us first at contact@shopnegro.com so we can try to resolve it informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in the State of California, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from bringing a claim in small claims court where eligible.

15. Notice to California consumers

16. California Proposition 65

WARNING: Tobacco products, including cigars, can expose you to chemicals including tobacco smoke, which is known to the State of California to cause cancer, birth defects, or other reproductive harm. 17. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they were last revised. Changes take effect when posted on the Site. Orders are governed by the Terms in effect when the order is placed. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right.
